Construction site injuries can be complex

On Behalf of | Jun 8, 2015 | Uncategorized |

We often talk about how important workers’ compensation benefits are for construction workers in particular due to the high-risk nature of the construction industry. Construction workers often work in dangerous environments with many risk factors, such as extreme heights and heavy machinery. Obviously this means that the slightest accident or misstep could result in serious injuries. While it is fortunate that these workers can take advantage of workers’ compensation benefits to help them recover, receiving the compensation you deserve can be complex.

There are many factors that contribute to a construction site accident, not the least of which is whether or not the necessary safety measures were taken and that the site was in compliance with safety regulations. However, even if all the safety measures are followed, there is still the question of who is liable for your injury, which could affect how much compensation you receive.

Many parties are involved in a construction site, and their actions can affect the safety of the project and the workers involved. Any of these parties or a combination thereof could thus be held responsible for injuries that occur if it can be proven that their negligence contributed to the injury. For example, if the person or party that owns the construction site has a degree of control over the site, then they could be liable for any injury caused by a dangerous property condition that they should reasonably have known about.

Other parties could also be liable for construction site injuries, and considering that caps that can be placed on workers’ compensation benefits in New York, it is important to know just how many parties were liable for your injuries. In order to get the maximum amount of compensation you deserve, it is recommended that you speak with an attorney who can analyze the case from an informed legal perspective.
