Know the worker’s compensation benefits you may be entitled to

Many of us are fortunate enough to have never experienced a workplace injury. Yet, accidents can happen to anyone, and it is important to be aware of your rights should you ever find yourself in need. The state of New York provides five main categories under which injured workers can seek compensation. If you have found yourself in the aftermath of a workplace injury, you may be entitled to one of the following forms of workers compensation:

  • Cash benefits – Suffering a disability will most likely require you to take time off work to recover. When you have to take more than seven days off, however, you may receive cash benefits to compensate for any work wages you lose.
  • Medical benefits – You can claim compensation for any medical care needed to treat your injuries, particularly if your healthcare provider is authorized by the Workers Compensation Board or if you are in a medical emergency. Medical benefits also cover any diagnostic tests your injury could require, such as brain scans or x-ray examinations.
  • Social Security benefits – Physical or mental disabilities that last longer than 12 months may qualify you for Social Security benefits, which exist to help you afford the necessary long-term medical care.
  • Supplemental benefits – Some workplace accidents may result in severe financial struggle for you or your family. For example, an accident may have caused you a permanent disability that prevents you from being able to earn as high an income as you previously did. Having your career drastically affected in such a way could qualify you to receive up to $215 per week in supplemental benefits.
  • Death benefits – An accident may even result in death, leaving behind financially dependent family members to face a drastic loss of income. A surviving spouse and minor children will be able to receive death benefits. This form of compensation comes in weekly cash payments, calculated to amount to two thirds of your loved one’s weekly wages.

You have the right to maximize your claim

Some of these benefits overlap with each other, which can make it easy to miss out on the full scope of compensation you may be entitled to. When you have suffered due to your company’s negligence, you have every right to file a claim for your losses, and to maximize your reimbursement. Consider consulting with a workers compensation attorney who can help you determine all your losses.
