Anyone who goes into the construction business accepts that there is certain level of risk. After all, the job normally involves working with heavy machinery, traversing scaffolding at great heights and using potential dangerous tools. However, it’s the job of the construction company and the manufacturers of this machinery to mitigate the risks and create a safe working environment for their employees. Sadly that doesn’t always happen. When an accident does occur, workers’ compensation is supposed to be there to help the injured worker take care of medical bills and any rehabilitation that might be necessary.
In late June, a construction worker was killed at a computer chip plant in New York. The man was one of six who were tasked with installing an air exchanger in the facility. There was no word on how the accident happened. While an investigation was launched into the incident, all further construction at the plant was halted.
In the event of a worker’s death, his or her spouse and surviving minor children are entitled to compensation if the workers’ comp is approved. Sometimes, though, workers’ compensation claims are not approved for various reasons. If the worker doesn’t report the accident quickly enough or the employer doesn’t notify the insurance company in a timely manner, it can be denied. Alternatively, employers can dispute claims in an attempt to deny benefits.
If your claim is denied, it does not mean you have no recourse. When benefits aren’t approved, an attorney may need to be contacted. He or she can conduct an investigation into the accident and may be able to gather evidence and build a case to appeal the denial.
