My workers' comp claim was denied. What are my options?

When accidental injuries occur, there are many issues that the injured party may be facing, including health care and recovery, financial burdens and issues of liability and fault. This is where legal assistance with personal injury claims can be important so that injured victims can make a claim to recover compensation that they deserve. Fortunately for workplace injuries, this is not usually the case. For most workplace injuries, compensation is fairly easy to recover.

Like many states, New York requires that employers have insurance coverage for workers' compensation, and depending on your employer's insurance, you may be entitled to a great deal of compensation for your injury. Because most employers care for their employees and genuinely want them to make a full, safe recovery from their injuries, these workers' compensation claims will be successful. Unfortunately, due to many different circumstances, this may not be the case.

There are a few reasons that a workers' compensation claim may be denied, many of which are simple issues of time. If your injury or claim is not reported or filed in time, you may have a difficult time making a successful claim. Discovering why your claim was denied is often the first, most important step in determining your next course of action. Depending on why your claim was denied, you may be able to appeal the decision.

Of course if your claim is denied in the first place, you will likely have a difficult time making an appeal because the insurance company may not want to grant you a payout. If this is the case, it is highly recommended that you meet with an attorney to learn more about your rights as an injured worker. Legal assistance can help you appeal your case to gain the compensation you deserve.
